DNA samples ordered in voter fraud case

TROY - A voter fraud case from last year is still making its way through local courts.

Two Troy city officials went before a judge Tuesday morning.

City Clerk William McInerney and Councilman Michael LoPorto were trying to resist being forced to turn over DNA samples.

A special prosecutor is trying to find out who filed fraudulent absentee ballot applications in Rensselaer County's Working Families Party primary.

“My argument was as a citizen, as an elected officer, that I stand up for my rights because if I can't stand up for my rights how can I stand up for anybody else's rights?” LoPorto said.

Unfortunately for LoPorto, Judge Stephen Herrick did not agree. The councilman and the city clerk were ordered to give up DNA samples.
